Terms of service
These terms are an agreement between you and 【TODO: legal entity name】 ("we"), the operator of Here. By creating an account you accept them, along with the privacy policy.
Who can use Here
- You must be 18 or older. Your date of birth is checked at signup and locked afterwards. If we come to believe an account belongs to a minor, we remove it.
- One account, yours, tied to your phone number. Don't let anyone else use it, and don't impersonate anyone.
- You must not have been previously banned from Here.
What the service is
Here shows you to other people only while you're physically at a participating venue with the app open, and shows you the people at the same venue. Matches are mutual. Conversations end — a chat lasts only as long as the design says it does, and transcripts are deleted on a schedule (see the privacy policy). We make no promise about who will be at a venue, that you will match with anyone, or that a venue will be participating on a given night.
Conduct
Here puts people in the same room, so the bar is the same as the bar in a room:
- Be the person your profile says you are. Photos must be of you.
- No harassment, hate, threats, or sexual content directed at someone who didn't ask for it.
- No means no — a pass, an unmatched chat, or a block ends the conversation. Don't use the venue to continue it.
- No commercial use: no advertising, solicitation, or sex work.
- No minors, no content sexualizing minors, in any form. See our child safety standards.
- No scraping, automation, or attempts to locate someone through the app beyond what it shows you.
Safety and moderation
- Every profile photo is scanned by automated moderation before it goes live.
- You can report or block anyone, from their profile or from a chat. Reports are reviewed by people. A block or a report permanently prevents the two of you from being shown to each other again, in both directions.
- We may remove content, restrict an account, or ban it — with or without notice — where we believe these terms were broken or someone's safety is at risk. Records of reports and blocks survive account deletion.
- We cooperate with law enforcement where the law requires it.
Your content
Your photos and messages are yours. You give us a limited, non-exclusive licence to host them, show them to other users according to how the app works (your profile to people at your venue; your messages to your match), and scan them for moderation. That licence ends when the content is deleted, except for copies retained for safety or as the law requires. You're responsible for having the right to upload what you upload.
Ending the relationship
You can close your account at any time, in the app — here's how. We can suspend or terminate your account for breaking these terms. Closing an account is permanent: signing in again with the same number starts a new account from scratch.
Disclaimers
Here introduces people; it doesn't vouch for them. Except for the automated and human moderation described above, we don't screen users, and verification (where offered) checks a face against a video, not a character. Use the same judgment you'd use meeting anyone: you're meeting in a public venue — keep it that way until you're comfortable, and tell someone where you are.
The service is provided "as is", without warranties of any kind, to the extent the law allows. To the same extent, our total liability to you is limited to 【TODO: liability cap — counsel to set】. Nothing in these terms limits liability that can't be limited under applicable law, including under Québec consumer protection rules.
Governing law
These terms are governed by the laws of 【TODO: province — TBD with counsel】 and the federal laws of Canada.
Changes
If we change these terms in a way that matters, we'll say so in the app before the change takes effect. Continuing to use Here after that means you accept the new terms.
